A New York company needs to evaluate all of these factors in order to determine whether a worker is an employee or independent contractor. Some factors to look for: Does the company control or have the right to control what the worker does and how the worker does his or her job; Are the business aspects of the job controlled by the employer; are there written contracts or employee benefits?
